Hence, in order to be sure that your affairs are in order and any specific inheritance requirements are met, a valid Will is a highly important document to have finalized prior to your death. Without a Will the state will decide how your estate is managed, which can lead to unintended beneficiaries inheriting from your estate, lengthy delays in the winding-up process, and potential disputes among surviving family members.
A valid Will enables you to:
- Appoint an executor of your choice;
- Nominate guardians for minor children;
- Specify how assets should be distributed;

Estate Duty: What You Need to Know
In South Africa, Estate Duty is a form of tax payable on the estate of a deceased person. The duty is governed by the Estate Duty Act 45 of 1955 and is currently levied at:
- 20% on the first R30 million of the dutiable estate, and
- 25% on the value exceeding R30 million.
Each individual is entitled to a primary abatement (deduction) of R3.5 million, meaning that no estate duty is payable if the net (total) value of your estate does not exceed this threshold.
Additional deductions may apply, such as:
- Liabilities at the time of death;
- Bequests to a surviving spouse (which are fully deductible);
- Funeral and administration costs;
- Donations made during the deceased’s lifetime.
